Terms

The terms that apply to this website and to our tender bidding and business development service. Commercial terms are agreed with each company in a signed services agreement; this page covers everything else.

Last updated 12 October 2026. Questions about this page go to hello@tenderanalyser.com.

1. Who these terms are with

TenderAnalyser is a trading name of Icebreaker Agency LLC, a Wyoming (USA) limited liability company, whose registered address is 30 North Gould Street, Ste R, Sheridan, WY 82801, United States (“we”, “us”). These terms cover your use of this website and, alongside a signed agreement, your use of the service. Where a signed agreement and these terms disagree, the signed agreement wins.

The service is sold to businesses. By using it you confirm you are acting for a company and are authorised to accept these terms on its behalf.

2. What the service does

We help contractors and service companies win work. We find public tenders and commercial opportunities that suit the company profile you give us, review the requirements and assess eligibility, and prepare tender responses and supporting documents for your approval. We support the submission process, but you submit, or authorise, every bid yourself. We also research main contractors, framework holders and commercial buyers, carry out targeted business-to-business outreach, and introduce you to buyers who have agreed to speak with you. Our own software, including large language models, supports this work.

3. What the service is not

This is a business development service, not advice and not a guarantee. Specifically:

  • We do not provide legal, tax, accounting or regulatory advice, and nothing the service outputs is a substitute for a qualified adviser.
  • We do not guarantee that you will win a tender, be found eligible, or that a bid prepared with the service will be accepted.
  • We do not sign contracts on your behalf, and we do not set your prices. You confirm the price, approve every submission and make the final commercial decisions.
  • We do not submit bids on your behalf, and we do not act as your representative before a contracting authority or a buyer.
  • You remain responsible for final approval and submission, for the accuracy of everything submitted in your name, for holding the qualifications, accreditations and insurance a contract requires, and for performing and delivering the work you win.

4. Automated output, and checking it

The analysis is produced by large language models. It can be incomplete or wrong, including on a requirement that matters. Every conclusion is linked to the passage in the source document it was drawn from, and you are expected to check anything you are going to rely on against that source and against the official tender documentation before you act on it. You accept that you use the output on that basis.

5. Public procurement data

Tender records and documents come from public procurement portals and open-data services run by governments and contracting authorities. We do not control those sources. We cannot guarantee that they are complete, current or accurate, and a tender may be amended, withdrawn or republished without us receiving it in time. The contracting authority's own published documentation is always the authoritative version, including for deadlines.

6. Your account

  • Keep your credentials confidential and do not share a login between people.
  • You are responsible for what happens under your account.
  • Tell us at once if you think someone else has access.
  • Give us accurate company information. The quality of the analysis depends directly on the accuracy of the profile you provide.

7. Acceptable use

You agree not to resell or redistribute the service or its output to third parties without our written agreement, not to use it to break the law or to interfere with a procurement process, not to attempt to breach or probe its security, not to scrape or bulk-extract it beyond your normal use, and not to reverse engineer it or use it to build a competing product.

8. Your content

The certificates, company information, documents and other material you upload stay yours. You grant us the permission we need to host, process and analyse that material in order to provide the service to you, and no more. We do not use your material to train language models, and we do not share it with other customers.

You confirm you are entitled to give us the material you upload. The software, interface, prompts and analysis methods behind the service remain ours.

9. Confidentiality

Each side treats the other's non-public information as confidential, uses it only to perform the engagement, and protects it at least as carefully as its own. This does not cover information that is already public, was already known without a duty of confidence, or must be disclosed by law.

10. Fees

We charge no retainers and no upfront bid preparation fees. We earn a success fee on contracts we help you secure, payable after you have received payment from your customer. The fee, which contracts it applies to and when it is due are agreed with each company in a signed services agreement before we start working together. Where you and TenderAnalyser have signed an agreement, its terms — including fees, governing law and jurisdiction — take priority over these website terms. Figures, scores and examples shown on this website are illustrative rather than customer data, and are not an offer or a binding quote.

11. Availability

We aim to keep the service running and monitored, but it is provided without a committed uptime level unless your signed agreement says otherwise. We may take it down for maintenance, and we may change or remove features as the product develops. We will give customers reasonable notice of a change that materially reduces functionality they depend on.

12. Liability

Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Subject to that, we are not liable for lost profit, lost business, a lost or unsuccessful tender, or indirect or consequential loss; and our total liability arising out of the service is limited to the fees you paid us for it in the twelve months before the event giving rise to the claim. Until a success fee has become payable under your signed agreement, the service is provided as is.

13. Suspension and termination

You can stop using the service at any time. We may suspend or end access if you materially breach these terms, if your use threatens the security or stability of the service, or if we are required to by law. On termination we handle your data as described in our privacy policy, and you can ask us for an export of your material before it is deleted.

14. Changes to these terms

We may update these terms, and will change the date at the top of this page when we do. If a change materially affects a customer under a signed agreement, we will tell them directly. Continuing to use the service after a change means you accept it.

15. Governing law

Unless a signed agreement says otherwise, these terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute. We would rather sort a problem out directly, so please raise it with us first.
